Terms of Service

1. What StreamPicks is

StreamPicks is a free-to-play mobile collectible card game built around online content creators. Within the Service you can:

• collect digital cards featuring creators;
• open card packs;
• battle in “Arena” — turn-based card matches against the game (solo / PvE) and against other players (PvP);
• draft and manage fantasy-style creator leagues, and form or join teams;
• use an in-game shop and economy, complete missions and a season pass, and earn cosmetic items.

StreamPicks is for entertainment only. It is not gambling, sports betting, investing, or a real-money game of chance, and digital items have no real-world cash value (see Section 8).

2. Eligibility & age

StreamPicks is for users aged 13 and over. You must be at least 13 years old to create an account or use the Service, and when you create an account you confirm that you are at least 13 years old. If you are under 13, you may not create an account or use StreamPicks. If you are at least 13 but under the age of majority where you live, you may use StreamPicks only with the involvement and consent of a parent or legal guardian.

• We do not knowingly allow children under 13 to create an account or provide personal information. If we learn that an account belongs to a child under 13, we will disable the account and delete any associated personal information.
• Live chat, community posting, and other social and interactive features are available to all registered users, all of whom are 13 or older.
• Making any purchase requires that you are old enough to do so and are authorized to use the payment method.

3. Your account

To use most features you create an account. You can sign in with Apple, Google, or an email and password. You agree to:

• provide accurate information and keep it current;
• keep your credentials secure and not share your account;
• be responsible for all activity under your account.

We may suspend, limit, or terminate accounts that violate these Terms, abuse the Service, or create risk for others or for StreamPicks.

4. Creators, names, images & likenesses (NIL)

StreamPicks features real, publicly known online creators as the subject of collectible cards and fantasy gameplay. Because this is the part of StreamPicks people ask about most, we want to be clear about it.

What we use. For each featured creator we may display:

• the creator's public name, channel name, or handle;
• publicly available information and statistics (such as subscriber or view counts and other public metadata) retrieved from public sources and third-party platform APIs;
• original, stylized card artwork that we create for StreamPicks and host on our own infrastructure;
• in some places, public profile images retrieved from third-party platforms.

It's a fan / commentary game, not an endorsement. Creators are featured for commentary, criticism, fandom, and entertainment. Card power levels, battle stats, rarities, and rankings are fictional and designed for gameplay balance — they are not a measure of, and do not purport to represent, any creator's real-world performance, earnings, character, or endorsement of StreamPicks.

Independence. Featuring a creator does not imply any partnership, sponsorship, affiliation, or endorsement. All creator names, marks, and likenesses remain the property of their respective owners. See Section 5.

Removal & opt-out (creator takedowns). If you are a featured creator, or you are authorized to act for one (a manager, agent, agency, attorney, parent/guardian of a minor, or rights owner), you may ask us to remove that creator from StreamPicks. Submit a request at streampicks.app/takedown or email streampicksapp@gmail.com. We review every request, may ask you to verify your identity or authority, and will remove verified creators from new packs, the in-game market, and gameplay surfaces, and stop generating their card art. Some references may briefly persist in cached or already-distributed content while changes propagate. We will not condition removal on any payment.

5. Platform & brand independence

StreamPicks is an independent product. It is not affiliated with, endorsed by, sponsored by, or otherwise associated with any creator or any content platform, including but not limited to:

• YouTube
• Twitch
• TikTok
• Instagram
• any other platform

All platform names, trademarks, logos, and creator marks belong to their respective owners and are used for identification, commentary, and entertainment purposes only.

6. Acceptable use

You agree not to:

• harass, threaten, abuse, impersonate, or harm other users or creators;
• post or transmit content that is illegal, hateful, sexual, violent, or otherwise prohibited (see Section 7);
• cheat, exploit bugs, use bots or automation, or manipulate matchmaking, scoring, the economy, or rankings;
• buy, sell, or transfer accounts, virtual items, or currency outside the Service;
• reverse engineer, scrape, decompile, or interfere with the Service or its security;
• access the Service through unauthorized means or attempt to obtain data you are not permitted to access.

We may remove content and suspend or terminate accounts that break these rules.

7. User content & community

StreamPicks lets you create content: a username, display name, and bio; team and deck names; messages in team and league chat; community posts and replies; suggestions; and a profile photo. You are responsible for what you submit.

Public by nature. Your username, display name, bio, profile photo, and similar profile content, along with content you post in shared spaces, are visible to other users.

Prohibited content. Do not post anything that is hateful, harassing, sexual or sexualizing of minors, violent, that promotes self-harm, that impersonates others, that contains slurs or profanity, that reveals others' personal information, that is spam, or that contains links. We use automated and human moderation, and you can report content. We may remove content, censor messages, and warn, time out, or ban accounts at our discretion.

License you give us. You keep ownership of your content. You grant StreamPicks a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and use the content you submit for the purpose of operating, moderating, and improving the Service. This license ends when your content or account is deleted, except for copies retained for backups, safety, or legal reasons, and for content others have shared or that we must keep by law.

You do not create the creators or creator cards in StreamPicks — those come from our catalog.

8. Virtual items & in-game currency

StreamPicks includes virtual items (such as cards, packs, cosmetics, and banners) and a virtual currency called Creator Coins.

• Creator Coins and virtual items are licensed to you for use within the Service. You do not own them.
• They have no real-world or cash value, cannot be redeemed, exchanged, or cashed out for money, and cannot be transferred or sold outside the Service.
• Creator Coins can be earned through gameplay or purchased with real money (see Section 9). Earned and purchased Coins may be treated the same in-game.
• We may modify, manage, regulate, or discontinue virtual items and currency, and may expire unused balances when your account is closed, to the extent permitted by law.

9. Packs & randomized items

Card packs contain a randomized selection of cards. Per-pack rarity odds and any “pity” rules are published on our drop rates page and inside the app, and update whenever rates change.

• Pack outcomes are random within the published odds; we do not guarantee any specific card.
• Packs are opened using Creator Coins. Because Coins can be purchased, packs may be obtained indirectly with real money.

10. Purchases, subscriptions & billing

StreamPicks is free to download and play. We offer optional purchases:

• StreamPicks Plus — an auto-renewing subscription (monthly or yearly) that adds convenience, higher limits, and cosmetics. It does not sell card-changing power.
• Coin bundles and a one-time Starter Bundle — consumable purchases of Creator Coins and items.

All purchases are processed by the Apple App Store or Google Play through your store account, and are subject to those stores' terms. Prices are shown in the app at the time of purchase.

Auto-renewal. A subscription automatically renews at the then-current price for the same period unless you cancel at least 24 hours before the end of the current period. Manage or cancel a subscription in your App Store or Google Play account settings; access continues until the end of the paid period.

Refunds. Purchases are generally final. Refunds, when available, are handled by the App Store or Google Play under their policies; we do not separately process store payments.

Price changes. We may change prices and offerings. Changes to an active subscription price are handled under the applicable store's rules.

11. Gameplay, scoring & changes to the game

StreamPicks is a live game. Card stats, scoring formulas, league and arena rules, the economy, drop rates, available creators, and features may change at any time to balance gameplay, fix issues, or improve the experience. Some gameplay elements may reference publicly available creator information; card stats and outcomes remain fictional and for entertainment. We do not guarantee the accuracy of third-party data or that any feature, creator, or item will remain available.

12. Our intellectual property

The Service — including its software, design, branding, original card artwork, text, and game systems — is owned by StreamPicks or its licensors and is protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, distribute, modify, reverse engineer, or create derivative works from any part of the Service except as allowed by law.

13. Termination

You may stop using StreamPicks and delete your account at any time (see our data deletion page). We may suspend or terminate your access if you violate these Terms, misuse the Service, or where required for legal, security, or operational reasons. On termination, your license to use the Service ends and virtual items and currency are forfeited, to the extent permitted by law.

14. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, secure, or that third-party data is accurate. You use the Service at your own risk.

15. Limitation of liability

To the maximum extent permitted by law, StreamPicks and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, lost virtual items or currency, or service interruptions, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law.

16. Indemnification

You agree to indemnify and hold StreamPicks harmless from claims, damages, and expenses arising out of your content, your use of the Service, or your violation of these Terms or the rights of others, to the extent permitted by law.

17. Governing law & disputes

These Terms are governed by the laws applicable where the operator of StreamPicks is established, without regard to conflict-of-laws rules, and you agree that disputes will be resolved in the courts of that jurisdiction, except where applicable consumer-protection law gives you a different right. Apple App Store and Google Play purchases are also subject to those platforms' terms.

18. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date, and for material changes we may ask you to re-accept in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
